TERMS OF USE


StockHop is a property of Digital Beach Software, LLC (“Digital Beach Software”,”DBS", "us", "we", the "company"). DBS has developed StockHop (the "App"), and associated StockHop Server (the "Server") (together known as the "Service" or "Services"). By using this App, you agree to comply with and be legally bound by the following terms of use ("Terms"), whether or not you become a registered user of the Services. If you do not agree to these terms, do not obtain information from or otherwise continue using this App. Failure to use this App in accordance with the following terms of use may subject you to cancellation of services. These terms and policies are in effect throughout the full term or duration of your use of the App and Services. You are responsible for regularly reviewing these Terms. Please review them carefully.


By accessing and using the information, tools, features and functionality located in StockHop or its associated email, telephone, and other messaging systems (collectively referred to as the “Service”), you are entering into a binding contract with DBS and you agree to be bound by all of the terms and conditions of this Agreement, whether you are a “Visitor” (that is, you have not registered with our apps) or you are a “Registered User” (that is, you have registered your account with our apps). The term “you” or “User” refers to a Visitor or a Registered User. The terms “we”, “us” and “our” refer to DBS.


By using the Service, you are indicating explicit acceptance of all of its terms.

By accepting this agreement, you represent that you have the capacity to be bound by its terms, or, if you are acting on behalf of a company or other entity, that you have the authority to bind such entity, in which case the terms “you” and “User” refer to such company or other entity.


The Service is provided to you solely as a means of helping you to view, organize, and analyze financial information. The Service does not provide legal, trading, investment, or other advice, and you are solely responsible for any decisions you make, and the consequences thereof, on the basis of any information provided by the Service.


You agree that you are responsible for verifying the accuracy of any information provided by the Service, and that the Service makes no express or implied warranty about the accuracy of the information it provides to you. No offer or solicitation to buy or sell securities, securities derivative or futures products of any kind, or any type of legal, tax, trading, investment advice, recommendation or strategy, is made, given or in any manner endorsed by DBS, the Service, or any affiliated third party.


You are only entitled to access and use our apps for lawful purposes. Accurate records enable us to provide the Service to you. You agree to provide true, accurate, current and complete information about yourself and your accounts maintained at other web sites as requested by the Service and you agree to not misrepresent your identity or your account information. You agree not to use the Service for anyone but yourself. You agree to keep your account information up to date and accurate. If you do not do this, the accuracy and effectiveness of the Service to you may be affected.


Monthly subscribers to plans in our apps will pay the Monthly subscription fee on a monthly basis. The initial service period of the monthly subscription is one month. The service will auto renew for subsequent one month periods.


Yearly subscribers to plans in our apps will pay the Yearly subscription fee on a yearly basis. The initial service period of the yearly subscription is one year. The service will auto renew for subsequent one year periods. All fees will be paid at the commencement of service.


Subscriber expressly authorizes Apple Inc. to automatically charge the applicable card, account, or other applicable payment method on a monthly or yearly basis during the term of this Agreement. Following the initial service period, DBS reserves the right to increase the Service Fee at any time which would take effect at the next billing cycle.  In this event, Subscriber may decline such an increase and elect to opt-out of the service, or agree to said increase and continue to receive the service.


The initial term of the Agreement is one (1) month for Monthly Subscription or one (1) year for Yearly Subscriptions. Following the initial term, the Agreement will auto-renew on a monthly or yearly basis at the current published subscription rates in force until otherwise terminated. The agreement can be terminated with subscribers following App Store's policy and instructions. For Monthly and Yearly Subscribers, auto-renewal will cease when subscribers successfully cancel their subscriptions following App Store's policy and instruction. The Service may be used until the paid through service expiration date is reached. After that point, the Subscriber's account will automatically become inactive and access to the Service will terminate.


DBS reserves the right to immediately suspend performance or terminate this Agreement without notice and without liability in (a) the event that the Subscriber fails to pay any amount due, (b) any content necessary for DBS perform its obligations become unavailable to DBS for any reason and/or (c) in the event of any conduct by Subscriber which DBS, in its sole discretion, considers to be unacceptable, or in the event of any breach by Subscriber of this Agreement. DBS may discontinue any of our subscription products at any time.


You agree that if DBS does not exercise or enforce any legal right or remedy which is contained in the Agreement (or which DBS has the benefit of under any applicable law), this will not be taken to be a formal waiver of DBS’s rights and that those rights or remedies will still be available to DBS.


This Agreement constitutes the entire Agreement between you and DBS with respect to the subject matter, and supersedes all other previous or contemporaneous agreements, whether written or oral, between the parties with respect to the subject matter described in this Agreement.
